1 Acceptance of Terms

By creating an account, enrolling in courses, or otherwise accessing the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

• You must be at least 16 years of age to use the Platform. Users between 16–18 require parental or guardian consent.
• If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
• We will notify registered users of material changes via email or Platform notification.

2 Description of Services

DawatiDaftarSwat is a Learning Management System (LMS) that provides:

• Online courses with video lessons, quizzes, assignments, and downloadable materials
• Structured programs combining multiple courses into certification pathways
• Live sessions and interactive webinars with instructors
• Progress tracking with dashboards and analytics for learners
• Certificate generation upon successful course or program completion
• Attendance management for institutional or classroom-based learning
• Communication tools including notifications, announcements, and contact forms

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice where practicable.

3 User Accounts

3.1 Registration

To access most features, you must create an account by providing accurate and complete information, including a valid email address. You may also register using third-party authentication providers (e.g., Google OAuth) where available.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Use a strong, unique password and not share it with anyone
• Immediately notify us of any unauthorized access or security breach
• Accept full responsibility for all activities conducted through your account

The Platform supports multiple account roles including Students, Instructors, and Administrators, each with distinct permissions and capabilities as defined by the Platform configuration.

4 Course Enrollment & Access

• Enrollment: You may enroll in courses through the Platform. Some courses are free; others require payment or institutional enrollment.
• Access duration: Course access is typically granted for the duration specified at enrollment. Some courses may provide lifetime access while others have fixed enrollment periods.
• Prerequisites: Certain courses or programs may have prerequisites that must be completed before enrollment is permitted.
• Guest access: Some course content may be accessible without an account for preview purposes, as determined by course administrators.
• Completion requirements: Each course defines its own completion criteria, which may include minimum lesson progress, quiz scores, and assignment submissions.

5 Payment & Refund Policy

5.1 Pricing & Payment

• Course prices are displayed in the applicable currency and are subject to change
• Payment is processed securely through third-party payment providers
• Where applicable, prices include or exclude taxes based on your jurisdiction
• Promotional pricing or discount codes are valid only under their stated terms

5.2 Refunds

• Refund requests are evaluated on a case-by-case basis
• Refund eligibility is determined by the refund policy in effect at the time of purchase
• Refunds, if approved, are processed via the original payment method within 7–14 business days
• Courses that have been substantially completed may not be eligible for a refund

6 Intellectual Property

All content on the Platform — including but not limited to course materials, videos, text, graphics, logos, software, and design — is the property of DawatiDaftarSwat or its content creators and is protected by copyright, trademark, and other intellectual property laws.

• You may access course content for your personal, non-commercial learning purposes only
• You may not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content without prior written consent
• Screen recording, downloading (unless expressly allowed), or sharing of course materials is strictly prohibited
• Trademarks, service marks, and logos displayed on the Platform are registered and unregistered trademarks of DawatiDaftarSwat

7 User-Generated Content

By submitting content to the Platform (e.g., reviews, forum posts, assignment submissions), you:

• Grant DawatiDaftarSwat a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Platform
• Represent that you own or have the necessary rights to submit the content
• Agree that your content does not violate any third-party rights or applicable laws

We reserve the right to remove any content that violates these Terms or our community guidelines, at our sole discretion.

8 Code of Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms
• Share your account credentials or allow unauthorized persons to use your account
• Engage in cheating, plagiarism, or academic dishonesty
• Harass, abuse, threaten, or discriminate against other users
• Upload malicious software, viruses, or any code designed to disrupt the Platform
• Attempt to gain unauthorized access to Platform systems, accounts, or data
• Scrape, crawl, or use automated tools to extract content or data from the Platform
• Interfere with the Platform's proper functioning or server infrastructure

Violations may result in account suspension, permanent ban, and/or legal action.

9 Certificates & Credentials

• Certificates of completion are issued based on meeting the course or program requirements defined by the Platform or instructor
• Certificates represent completion of course material and do not constitute accredited degrees, professional licenses, or government-recognized qualifications unless explicitly stated
• Certificate verification may be available through the Platform's verification system
• We reserve the right to revoke certificates issued through fraudulent means or policy violations

10 Privacy & Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. Key highlights:

• We collect only the data necessary to provide and improve our services
• Your data is protected by industry-standard security measures
• We do not sell personal information to third parties
• You have rights regarding your data, including access, correction, and deletion

11 Disclaimers & Limitation of Liability

• The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
• We do not guarantee uninterrupted, error-free, or secure access to the Platform
• Course content is provided for educational purposes and should not be considered professional advice
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability is limited to the amount you paid for the specific service giving rise to the claim, or $100, whichever is greater
• We do not guarantee specific outcomes, employment, or results from course completion

12 Termination & Account Deletion

12.1 By You

You may request account deletion at any time through your profile settings. Upon deletion:

• Your account will be soft-deleted with a 30-day retention period, during which you may reactivate by logging in
• After 30 days, your account and associated personal data will be permanently deleted
• Account deletion requires identity verification via OTP sent to your registered email

12.2 By Us

We reserve the right to suspend or terminate accounts that violate these Terms, including but not limited to:

• Repeated violations of the Code of Conduct
• Fraudulent activity or misuse of the Platform
• Extended periods of inactivity (with prior notice)
• Legal or regulatory requirements

13 Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which DawatiDaftarSwat operates. Any disputes arising from these Terms or your use of the Platform shall be resolved through:

1. Informal resolution: Contact us first to attempt to resolve the matter amicably
2. Mediation: If informal resolution fails, parties agree to attempt mediation
3. Arbitration or litigation: As a final recourse, disputes will be submitted to binding arbitration or the courts of competent jurisdiction
